James Vivenzio has told a tale about the Kappa Delta Rho fraternity that has nothing to do with brotherhood and honor.

STATE COLLEGE — Standing in front of the fraternity house where he alleges he was brutally hazed, former Penn State student James Vivenzio described the “emotionally draining” videotaped tour he gave of the house as part of his civil case against the fraternity and others.

The videotaped in-house tour went over the basement and first-floor common rooms of the former Kappa Delta Rho fraternity house at 420 East Prospect Avenue in State College, where Philadelphia-based attorney Aaron Freiwald said fraternity members and alumni “terrorized” his client in ways similar to prisoners of war.  Read more at The Patriot News

Philadelphia, PA (August 20, 2015) – James Vivenzio, the Penn State fraternity hazing victim turned whistleblower, today added an online petition to his www.endhazingnow.com website to urge colleges and universities to increase prevention education and strengthen sanctions to help stop the often life-threatening criminal behavior that for too long has been minimized or dismissed as harmless pranks by playful college students.

In the petition, also posted onto www.change.org and www.ipetitions.com, Mr. Vivenzio urges colleges and universities to do much more to “prevent and end what has become increasingly more violent and demeaning behavior in the name of good clean fun.” The petition, accompanied by a personal narrative about his own experiences as a hazing victim, urges schools to “commit meaningful annual resources for mandatory anti-hazing and anti-sexual violence training and awareness programs on campus. It also calls for the establishment of an “independent, truly confidential hotline so that incidents of hazing and sexual violence can be reported to university officials and law enforcement.”

The petition is launched as students are preparing for the start of a new school year, and in conjunction with numerous highly effective advocacy groups such HazingPrevention.Org to stop hazing and sexual assault in all forms at all levels in America’s schools.

“We are excited and grateful for the support of James Vivenzio and his family in encouraging people to join the hazing prevention movement and share their story, through our These Hands Don’t Haze Mosaic project.” said Emily N Pualwan, Executive Director of HazingPrevention.Org. “ Awareness of hazing’s dangers is always the first step in empowering people to stand up and make a change to end this dangerous and harmful practice.” Her organization sponsors the annual National Hazing Prevention Week, which starts September 21.

Mr. Vivenzio recalled in the petition posting that when he rushed Kappa Delta Rho fraternity at Penn State he and the others in his pledge class were “repeatedly assured there was a strict, zero tolerance no-hazing policy.” However, he added, “I learned the hard way, in a very painful way, physically and psychologically, that KDR did not live by the motto over the front door of the house, “Honor Above All.” He has characterized his physical and mental abuse as having occurred in a “house of horrors”.

July 9, 2015

A former Kappa Delta Rho brother who  filed a lawsuit against the fraternity and Penn State last month is asking for documents from the university, the fraternity’s national chapter, and to return to the Prospect Avenue fraternity house as part of trial preparation.

Attorneys for James Vivenzio wrote in Tuesday court filings that he and his client are seeking access to records, to include emails and other communications, regarding any investigations of hazing at the fraternity conducted by the university, Penn State’s Interfraternity Council and Kappa Delta Rho’s national organization, to include the ones that led to sanctions earlier this year.  Read more at Centre Times Daily

Lawyers for a former Penn State fraternity brother have requested a basement-to-attic forensic inspection of the Kappa Delta Rho fraternity house as the group faces a deluge of hazing allegations.

The request to view the house and record it through videotape or by photographs was made Wednesday as part of pre-trial filings made by Philadelphia-based attorney Aaron J. Freiwald on behalf of 21-year-old James Vivenzio. Vivenzio, of Great Falls, Virginia, has been regarded as a whistleblower claiming “physical intimidation, psychological intimidation and social intimidation” during the Kappa Delta Rho fraternity’s months-long pledging process.   Read more at Pennlive.com

STATEMENT OF ATTORNEY AARON FREIWALD

June 8, 2015 / 3:15 p.m.

Penn State’s dismissive and demeaning statement is false and misleading in an attempt to conceal and blur the truth, and compounds the suffering of James Vivenzio.  In April 2014, at a meeting lasting several hours in the family’s home, Danny Shaha, the University’s chief investigator, was shown dozens and dozens of pages of of documentation, including photos from the Facebook 2.0 page, supporting the claims in the complaint filed today.  The family also pledged full cooperation with any university investigation.  The subject of filing an internal complaint about the hazing abuses with the University never came up. In addition, James and his family have always been cooperative with State College Police, who he went to after eight months and after losing confidence in the University to pursue his claims. We look forward to presenting all of the evidence in this case to a jury.

On June 8, former Penn State student James Vivenzio filed a complaint in Pennsylvania court alleging his fraternity was responsible for hazing and sexually abusive activities. Among other things, he alleges the fraternity chapter of Kappa Delta Rho maintained a Facebook page with photos of drunk and unconscious nude women, some of whom looked like they were being sexually assaulted. Fraternity pledges were given alcohol and sometimes drugs to facilitate sexual assault and abuse, the complaint alleges.  Read more at Forbes…

PennLive.com – Hazing across campus: How universities handle the dark side of student life

Drinking bucketfuls of alcohol mixed with hot sauce, cat food and urine. Consuming liquor while performing wall sits and push-ups until passing out. Being punched, battered and burned with cigarettes. Completing push-ups on a floor covered in broken glass, cigarettes and bleach.

When James Vivenzio announced his negligence lawsuit last week — alleging Penn State University, among others, did not take steps to prevent the university’s chapter of Kappa Delta Rho from hazing — he had a disturbing list of actions he said he and other pledges were forced to endure to gain entry into the fraternity.  Read more at Pennlive.com

Philadelphia Magazine – 9 Most Shocking Parts of the PSU Whistleblower’s Lawsuit

Tags :

Philadelphia Magazine

June 9, 2015

James Vivenzio, a former member of Penn State’s Kappa Delta Rho, sued the school and fraternity on Monday over hazing. He is the whistleblower who told police in January that KDR maintained a Facebook page where members posted photos of nude, unconscious women, hazing and drug sales.

We’re not easily shocked, but we have to say, his allegations are pretty stunning. In the lawsuit, Vivenzio and his attorney, Aaron Freiwald, say KDR hazed pledges in bizarre and gut-wrenching ways — such as forcing them to drink their frat brothers’ urine — and that the university turned a blind eye to it all.

Here are nine other horrific parts of Vivenzio’s complaint:  Read more at Philadelphia Magazine
