Florida State reaches settlement with Jameis Winston’s accuser

Florida State has settled a federal Title IX lawsuit with the former student who alleged that former Seminoles quarterback Jameis Winston sexually assaulted her in December 2012.

The school will pay $950,000, which attorneys for accuser Erica Kinsman say is the largest payment ever to a single plaintiff claiming a school’s indifference to a sexual assault allegation. The settlement agreement says Kinsman will receive $250,000 and her attorneys will get $700,000, though the agreement notes that might not be the actual split of the total settlement.

Plaintiff in Penn State hazing suit, lawyers tour frat house

STATE COLLEGE, Pa. (AP) — A former Penn State student who is suing over alleged hazing toured his former fraternity house with his parents and lawyers for the involved parties.

James Vivenzio’s attorney, Aaron Freiwald, says the tour was a last-ditch chance to find evidence in the case. That’s because Kappa Delta Rho, which owns the property, has been suspended and a different fraternity takes over the property this weekend.

Penn State officials didn’t comment, referring reporters to a statement issued when Vivenzio sued in June that says the school “strongly disputes” the allegations.

Vivenzio contends he was burned with cigarettes and force-fed buckets of liquor mixed with urine, vomit and hot sauce in hazing rituals.

He also blew the whistle on a covert Facebook page on which frat members posted pictures of nude and semi-nude women.  Read more at SFGate

James Vivenzio leads videotaped inspection of former Kappa Delta Rho house

After completing a videotaped walk-through of the former Kappa Delta Rho fraternity house, James Vivenzio walked across the lawn of his former fraternity “pretty sad,” after describing to camera crews for the past hour events that took place in what his lawyer referred to as a “house of horrors.”

An inspection of the fraternity house was set for Wednesday, Vivenzio’s attorney Aaron Freiwald said, to preserve evidence of where Vivenzio alleges his hazing occurred.  Read more at The Daily Collegian

As James Vivenzio stood outside the former Kappa Delta Rho house with his attorney on Wednesday, a rusted golden car driving down East Prospect Avenue slowed to a crawl.

The driver – a young man with the steering wheel in one hand and a red solo cup in the other – watched for a moment as Vivenzio spoke to his lawyers and a camera crew documenting where Vivezio was allegedly hazed as a KDR pledge in the fall of 2014.  Read more at StateCollege.com

STATE COLLEGE — Standing in front of the fraternity house where he alleges he was brutally hazed, former Penn State student James Vivenzio described the “emotionally draining” videotaped tour he gave of the house as part of his civil case against the fraternity and others.

The videotaped in-house tour went over the basement and first-floor common rooms of the former Kappa Delta Rho fraternity house at 420 East Prospect Avenue in State College, where Philadelphia-based attorney Aaron Freiwald said fraternity members and alumni “terrorized” his client in ways similar to prisoners of war.  Read more at The Patriot News

Penn State Hazing Whistleblower Case Update: Kappa Delta Rho Fraternity Inspection Noon, Wednesday, August 26th

State College, PA (August 24, 2015) – Penn State Hazing Whistleblower James Vivenzio will participate in the premises inspection of the Kappa Delta Rho fraternity house at noon, Wednesday, August 26, 2015, according to Freiwald Law, P.C., which represents the former fraternity member and moving force behind the hazing prevention and campus safety advocacy website www.endhazingnow.com.

Aaron J. Freiwald, Mr. Vivenzio’s lead attorney in the civil action (Philadelphia Court of Common Pleas, April Term, 2015 No. 001671) said that attorneys for the defendants will also be present as his client conducts a videotaped walk through of certain areas, starting in the basement, of the building located at 420 E. Prospect Ave., State College. He explained that lawyers for Zeta Alumni of Kappa Delta Rho, a group of KDR alumni that own the building, limited the scope of the inspection to the basement and first-floor common rooms. They also rejected requests to allow members of the news media to cover the inspection.

“We will have an opportunity to view first-hand, with Mr. Vivenzio present, the exact locations where he was brutally hazed over a period of months,” Mr. Freiwald said. “It was imperative that the inspection take place this week, we were told, as the KDR alumni owners are leasing the property to another fraternity at Penn State.”

Since the Defendant has refused to permit members of the media inside the fraternity house, Mr. Freiwald said he and Mr. Vivenzio expect to be available to media representatives following the inspection at approximately 1 p.m.

Philadelphia, PA (August 20, 2015) – James Vivenzio, the Penn State fraternity hazing victim turned whistleblower, today added an online petition to his www.endhazingnow.com website to urge colleges and universities to increase prevention education and strengthen sanctions to help stop the often life-threatening criminal behavior that for too long has been minimized or dismissed as harmless pranks by playful college students.

In the petition, also posted onto www.change.org and www.ipetitions.com, Mr. Vivenzio urges colleges and universities to do much more to “prevent and end what has become increasingly more violent and demeaning behavior in the name of good clean fun.” The petition, accompanied by a personal narrative about his own experiences as a hazing victim, urges schools to “commit meaningful annual resources for mandatory anti-hazing and anti-sexual violence training and awareness programs on campus. It also calls for the establishment of an “independent, truly confidential hotline so that incidents of hazing and sexual violence can be reported to university officials and law enforcement.”

The petition is launched as students are preparing for the start of a new school year and as National Hazing Prevention week approaches.

“We are excited and grateful for the support of James Vivenzio and his family in encouraging people to join the hazing prevention movement and share their story, through our These Hands Don’t Haze Mosaic project.” said Emily N. Pualwan, Executive Director of HazingPrevention.Org. “ Awareness of hazing’s dangers is always the first step in empowering people to stand up and make a change to end this dangerous and harmful practice.” Her organization sponsors the annual National Hazing Prevention Week, which starts September 21.

Mr. Vivenzio recalled in the petition posting that when he rushed Kappa Delta Rho fraternity at Penn State he and the others in his pledge class were “repeatedly assured there was a strict, zero tolerance no-hazing policy.” However, he added, “I learned the hard way, in a very painful way, physically and psychologically, that KDR did not live by the motto over the front door of the house, “Honor Above All.” He has characterized his physical and mental abuse as having occurred in a “house of horrors”.

A national fraternity has dropped its motion to bar a former Penn State University student and his attorney from releasing information to the public as the two sides navigate a hazing lawsuit.

“The parties have reached a resolution by which the Endhazingnow.com website will continue to present public information, including that relevant to the litigation, as well as information that helps to educate about and advocate for an end to hazing and sexual assault in any form on campuses,” Philadelphia-based  attorney Aaron Freiwald said in a released statement.  Read more at The Patriot News

Frat that inspired ‘Animal House’ avoids hazing charges for branding members

HANOVER, N.H. — Authorities in New Hampshire say they’ve found insufficient evidence to charge a Dartmouth College fraternity accused of branding new members.

Alpha Delta, which partly inspired the 1978 movie “Animal House,” lost its status as a student organization in April after a string of disciplinary violations including hazing and underage service of alcohol.  Read more at The New York Post
