Kappa Delta Rho drops motion to protect information in Penn State hazing case

A national fraternity has dropped its motion to bar a former Penn State University student and his attorney from releasing information to the public as the two sides navigate a hazing lawsuit.

“The parties have reached a resolution by which the Endhazingnow.com website will continue to present public information, including that relevant to the litigation, as well as information that helps to educate about and advocate for an end to hazing and sexual assault in any form on campuses,” Philadelphia-based  attorney Aaron Freiwald said in a released statement.  Read more at The Patriot News

‘The facts are facts’ in PSU hazing case facing possible gag order, attorney says

Attorney Aaron Freiwald has no intention of agreeing to any type of gag order in the lead up to a possible trial addressing hazing allegations launched against a national fraternity.

And, when it comes to the pending decision, he does not think the court will pass the protective order requested by the Kappa Delta Rho fraternity, which has expelled dozens of fraternity members from its local Penn State University chapter.   Read more at PennLive.com

The following statement is issued in response to media inquiries regarding the filing of a defense motion for a protective order in the case of James Vivenzio vs. Pennsylvania State University, Kappa Delta Rho, et. al. (Philadelphia Court of Common Pleas, April Term 2015 No.150401671)

Fraternity seeks gag order in KDR hazing lawsuit

One of the defendants in the lawsuit brought by a Penn State student who says he was hazed wants to stop the man from publishing information about the case.

The National Fraternity of Kappa Delta Rho filed papers in Philadelphia last week asking for a protective order.

James Vivenzio, 21, is suing Penn State, KDR’s national organization and its local Zeta chapter, the university’s Interfraternity Council and the Panhellenic Association, charging negligence, battery, furnishing alcohol to a minor, serving a visibly intoxicated person, false imprisonment and conversion of thousands of dollars in dining plan funds.  Read more at Centre Daily Times.
